Context

As the professional organization representing the interest of the four Music Majors, SNEP lead litigation against Sacem operating as the mechanical rights collections companies for the French market. The litigation spanned the three prior years and the ongoing exploitation period for all music recorded on videos, including rights attached to directors of the video production. € 40.0 million rights invoiced by Sacem and retained by Majors were overdue.€ 5.0 million in a total refund in respect of tariffs reduction for Major, were at stake.

Approach

Audited all value streams at stake per Major, period, types of rights, Designed a new rights tariff scheme, Supported the financials and accounting to settle the litigation, Provided the communication and reporting support to all stakeholders.

Outcomes

New tariffs model, Support for negotiation rounds including financial modeling and complete accounting, Report and official communications of new Terms and Conditions to all Majors and European Rights Collection Societies through the Central Licensing Agreement.
